1. Introduction and definitions

These Terms and Conditions (the “Terms”) govern the use of the website openbustourischia.com and the purchase of our panoramic open-top bus sightseeing tour on the Island of Ischia (the “Service”), operated by OpenBus Tour Ischia (the “Provider”).

By placing a booking the Customer declares to have read, understood and fully accepted these Terms.

2. Description of the Service

The Service consists of a circular panoramic tour of the Island of Ischia lasting approximately 2 hours and 50 minutes, on board open-top buses departing from and returning to the Forio terminus. The route crosses all six municipalities of the island: Forio, Lacco Ameno, Casamicciola Terme, Ischia, Barano d'Ischia and Serrara Fontana.

The Service is subject to daily availability. The Provider reserves the right to vary the route, departure times and stops for operational, safety, weather or traffic reasons, without this entitling the Customer to refunds other than those expressly set out herein.

3. Bookings and price

  1. Bookings are made online through the dedicated form on the website.
  2. Prices are shown in Euro (EUR) and include VAT at the applicable rate.
  3. The adult fare is currently €20.00; the child fare is currently €20.00. Promotional fares, group discounts or seasonal offers may apply and will be communicated at checkout.
  4. A booking is confirmed only after the online payment has been successfully completed.
  5. The Provider will send a confirmation e-mail with a unique booking code and a digital ticket (QR code) to be presented when boarding.

4. Payments

Payments are processed by Stripe Payments Europe, Ltd. through a PCI-DSS Level 1 secure environment. The Provider does not store full payment-card data on its servers. Please refer to the Privacy Policy for details on the processing of payment data.

Bookings in status “pending” or “awaiting payment” that are not paid within 12 hours of creation are automatically cancelled. For bookings made for a tour starting in the immediate hours afterwards, automatic cancellation takes place 1 minute before the scheduled departure time. A cancelled booking cannot be restored and the seats are released to other Customers.

5. Cancellations and refunds

  1. Cancellation by the Customer: the Customer may cancel a confirmed booking by contacting the Provider via e-mail (info@openbustourischia.com) at least 24 hours before the scheduled departure and receive a full refund.
  2. Cancellations made between 24 and 2 hours before departure entitle the Customer to a 50% refund.
  3. Cancellations made less than 2 hours before departure, no-shows or late arrivals are not entitled to any refund.
  4. Partial refunds: in case of a multi-passenger booking the Customer may request the refund of one or more specific tickets, leaving the others active.
  5. Cancellation by the Provider: if the tour is cancelled due to force majeure, adverse weather, technical issues, strikes or other causes beyond the Provider's control, the Customer is entitled to a full refund of the amount paid, with no further compensation.
  6. All refunds are credited to the original payment method within 3-5 business days.

6. On-board code of conduct

The Customer agrees to:

  • arrive at the terminus at least 10 minutes before the scheduled departure;
  • show the digital ticket (QR code) to the driver when boarding;
  • follow the instructions of the driver and on-board staff;
  • remain seated while the vehicle is moving;
  • not lean beyond the safety structures of the open-top bus;
  • supervise minors at all times;
  • not smoke and not consume food or alcoholic beverages on board;
  • wear clothing suitable to the weather conditions; a hat and sunscreen are recommended on sunny days.

Staff is authorised to disembark passengers who fail to comply with safety rules or who behave inappropriately, without any right to a refund.

7. Liability

The Provider is liable within the limits set by applicable law on passenger transport. The Provider shall not be liable for:

  • personal items lost, forgotten or damaged on board;
  • damages arising from the Customer's failure to follow safety instructions;
  • delays, route changes or suspension of the Service caused by force majeure, weather events, traffic, public events, orders from the authorities or other causes beyond the Provider's control.

In any case the Provider's liability towards the Customer is limited to the amount paid for the ticket.

8. Intellectual property

All website content (texts, images, video, trademarks, logos, layouts, code) is owned by the Provider or by its licensors and is protected by copyright law. Total or partial reproduction without prior written authorisation is prohibited.

9. Governing law and jurisdiction

These Terms are governed by Italian law. Any dispute that cannot be resolved amicably shall be referred exclusively to the Court of Naples (Italy), without prejudice to the mandatory consumer jurisdiction where applicable (art. 66-bis of Italian Legislative Decree 206/2005).

10. Consumer right of withdrawal

Pursuant to article 59(1)(n) of Italian Legislative Decree 206/2005 (Consumer Code) — implementing Directive 2011/83/EU — the 14-day right of withdrawal does not apply to passenger transport contracts with a specific date or period of performance. The cancellation and refund rules set out in section 5 above therefore apply exclusively.

11. Online Dispute Resolution (ODR)

Consumers may submit complaints and access the European Online Dispute Resolution platform at: https://ec.europa.eu/consumers/odr/.

12. Changes to these Terms

The Provider reserves the right to amend these Terms at any time by publishing the updated version on this page. Amendments apply to bookings placed after the update date.
